Terms of Service
The rules for using Yaybe. Plain language, draft pending legal review.
Draft for review. These terms have not yet been reviewed by a lawyer.
These terms apply to everyone who visits or uses yaybe.com (“Yaybe”, “we”, “us”). By using Yaybe you agree to them. If you open a shop, the Seller Terms apply as well.
1. What Yaybe is
Yaybe is a marketplace and social platform where members (“sellers”) open shops and list products, and visitors and members (“buyers”) discover them. Yaybe does not sell products and does not process payments. Every purchase happens between the buyer and the seller on the seller’s own payment page, which is outside Yaybe. The seller is responsible for the product, the price, delivery, taxes, refunds and customer service.
2. Accounts
You need an account to follow shops, save favourites, review, comment or open a shop. You sign in with a one-time code sent to your email; keep access to that email secure. You must be at least 18, or the age of majority where you live, to open a shop. One person may hold one account. You are responsible for what happens under your account.
3. Acceptable use
You agree not to:
- post anything illegal, infringing, deceptive, hateful or harassing;
- list or promote prohibited items;
- impersonate a person, brand or shop, or misrepresent a product;
- post reviews or comments you were paid for, or about a purchase that didn’t happen;
- scrape, overload or interfere with the service, or bypass its security;
- use Yaybe to send spam or collect other members’ data.
We may remove content, suspend accounts or close shops that break these rules, with or without notice.
4. Your content
You keep ownership of what you post (photos, descriptions, posts, reviews). You give Yaybe a worldwide, royalty-free licence to host, display, reproduce and adapt it as needed to run and promote the service, including in search previews, social cards and feeds. You confirm you have the right to post it. Reviews and comments may be kept after you delete your account, attributed to “Former member”.
5. Reviews and comments
Star reviews can only be left by members whose purchase the seller has confirmed. Comments are open to confirmed buyers of that shop and to Pro sellers. Sellers may reply once to each review. Reviews must be honest and about your own experience.
6. Reporting
Any member can report a shop, product, post, review, comment or profile. Reports are reviewed by moderators. Reporters receive a short outcome notice by email.
6a. Offerings, matches and bookings
- An offering (a product, service, rental, space, job, event or stay) is your own listing. Yaybe does not process your sales: payment and booking happen on the page you link to, under your own terms with your customer.
- A match is an introduction, not a contract. Both sides opt in before anyone’s identity is shared; what you agree afterwards is between you.
- A booking request is a request until the provider confirms it. Cancellations, deposits and refunds follow the provider’s own terms; Yaybe holds no money for either side.
- Reviews after a completed match or booking must be honest and about the service received.
6b. Add-ons and billing
- Add-ons are optional monthly subscriptions per place, billed by Stripe in Canadian dollars plus applicable taxes. You can change or cancel them anytime from your billing page; the change applies at the end of the paid period unless stated otherwise.
- If a payment fails, the add-on keeps working for seven days; after that it ends and the free tier’s limits apply again. Nothing you created is deleted: listings past the free cap are paused until you publish them again or resubscribe.
- Add-ons granted by Yaybe without payment can be withdrawn with notice.
7. Disclaimer and liability
Yaybe is provided “as is”. We don’t guarantee that any listing is accurate, that any seller will deliver, or that the service will be uninterrupted. To the extent permitted by law, Yaybe is not liable for any loss arising from a purchase, from content posted by members, or from use of the service, and our total liability to you is limited to CA$100. Nothing in these terms limits liability that cannot be limited by law.
8. Changes and termination
We may update these terms; the date at the top changes when we do, and material changes are announced on the site. You can delete your account at any time from your settings. We may suspend or end access for breach of these terms.
9. Governing law
These terms are governed by the laws of the Province of Nova Scotia and the federal laws of Canada applicable there. Disputes are brought in the courts of Nova Scotia.
